Lead Ad Terms
Facebook provides a feature that allows you to serve an ad unit through which someone using Facebook can provide you with their email address or other information about themselves ( “Lead Ads” ). When you click “OK” and use this feature, you agree to the following:
A. It is your sole responsibility to ensure that each Lead Ad you submit complies with these policies, as well as the RFI (as defined below, including Facebook’s Advertising Policies located at the address https://www.facebook.com/policies/ads , which includes the Lead Ads Policy, and the Facebook Platform Policy, available at https://developers.facebook.com/policy/ ), and all applicable laws, rules, and regulations (including providing everyone who uses Facebook with the necessary information). If you are accepting these terms on behalf of a third party, you represent and warrant that you have the authority as such third party’s agent to use this functionality on their behalf and to bind it to these terms.
B. You will ensure that each Lead Ad includes the following information for individuals who use Facebook: (i) all necessary and sufficient information and choice mechanisms to comply with applicable laws, rules and regulations, including any necessary terms of offer presented in the Lead Advertising (for example: qualification criteria, expiration date or usage limits) (“Conditions of the Offer” ); (ii) clear and prominent information that if someone submits data to you through a Lead Ad, that data will be governed by your privacy policy; and (iii) a link to your privacy policy. You will also ensure that no Lead Advertising targets minors.
C. “Lead Ad Data” means information that a Facebook user chooses to send to you through a Lead Ad. This can be their email address or any other information about that person.
d. You may only use Data from Lead Ads in accordance with these terms; Facebook Platform Rules; Facebook Advertising Policies; your privacy policy and any Terms of Offer, any consents or additional terms accepted by the person using Facebook when consenting to provide Lead Ads Data to you through Lead Ads and all applicable laws, rules and regulations (including all applicable laws relating to data privacy, advertising, telemarketing or otherwise, including, where applicable, the United States Telephone Consumer Protection Act of 1991 and its implementing regulations, 47 USC § 227 and 47 CFR § 64.1200 and the “Telemarketing Sales Rule”, 16 CFR Part 310, the United States “Controlling the Assault of Non-Solicited Pornography and Marketing Act” of 2003 and its implementing regulations, 15 USC § 103 and 16 CFR Part 316). If you receive Data from Lead Ads on behalf of an advertiser, you may only use or share such Data on behalf of that advertiser, and you may not augment, combine or supplement such Data. from Lead Ads with any other data from any other advertiser.
E. Under no circumstances may you sell Data from Lead Ads and you may not transfer such Data, except as provided in the following sentence. Subject to the terms of your privacy policy, these Terms, any Offer Terms, and your compliance with applicable laws, rules, and regulations, Facebook does not prohibit you from transferring Lead Ads data to a company. affiliate, franchisee or third party acting solely on your behalf to fulfill the purpose for which Lead Ad Data was collected (as described to the user at the time of collection). In the event that you share Lead Advertising Data with an affiliate, franchisee or third party acting on your behalf, you do so solely at your own risk, and you also ensure that such affiliate, such franchisee or such third party shall comply with these Terms and all applicable laws, rules and regulations. “Affiliate” means an entity that directly or indirectly owns or controls you, or that you own or control, or that comes under common ownership or control with you.
f. You will put in place adequate technical and organizational measures to protect Data from Form Advertisements against accidental or unlawful destruction, accidental loss, modification or unauthorized access or disclosure, and which ensure an appropriate level of security. the risks represented by the processing and the nature of the data to be protected. Lead Ad Data may be made available to you through protocols specified by Facebook (including Facebook’s APIs), and your use of such protocols must comply with Facebook’s Platform Rules.
G. Facebook reserves the right to modify, suspend or terminate access to Lead Ads, or withdraw this feature at any time. You can stop using the Lead Ads feature at any time.
These terms govern your use of the Lead Ads feature. They do not replace any terms applicable to your purchase of Facebook ad inventory (including, without limitation, Facebook’s Advertising Policies), and those terms will continue to apply. This Lead Ads feature is part of “Facebook” under the Facebook Statement of Rights and Responsibilities ( https://www.facebook.com/legal/terms , the “DRO”). Your use of this feature is considered part of your use of “Facebook” and your actions on the platform. In the event of a conflict of laws between these Terms and the RFI, those Terms will control with respect to your use of the Lead Ads functionality and only to the extent of the conflict. Facebook reserves the right to monitor or audit your compliance with these Terms, and to update these Terms from time to time. Your use of this feature after such changes indicates your acceptance of them.
